Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the CuberPal mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

CuberPal is a speedcubing practice application that provides:

  • WCA-standard timing functionality
  • Scramble generation for various puzzle types
  • Statistics tracking (averages, personal bests)
  • Video recording of solves
  • AI-powered analysis and feedback (Premium feature)
  • Session and solve history management

3. User Accounts

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized account use
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

4. Subscriptions and Payments

Premium Subscription

CuberPal offers a premium subscription that provides access to AI-powered analysis features. Subscription options include:

  • Monthly subscription: $9.99/month
  • Annual subscription: $79.99/year (save 33%)

Billing

Subscriptions are billed through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

Cancellation and Refunds

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. Refunds are handled by Apple according to their refund policy.

5. User Content

You retain ownership of any content you create or upload to the App, including video recordings of your solves. By using the App, you grant us a limited license to:

  • Process video recordings through our AI analysis service
  • Store solve data and statistics on your behalf
  • Use anonymized, aggregated data to improve our services

You are responsible for ensuring you have the right to upload any content and that your content does not violate any laws or third-party rights.

6. Prohibited Uses

You agree not to:

  • Use the App for any illegal purpose
  • Attempt to reverse engineer or decompile the App
  • Interfere with or disrupt the App's servers or networks
  • Create multiple accounts to abuse free features
  • Share your account credentials with others
  • Use automated systems or bots with the App
  • Upload malicious content or attempt to exploit vulnerabilities

7. Intellectual Property

The App, including its design, features, code, and content (excluding user content), is owned by CuberPal and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI ANALYSIS RESULTS ARE PROVIDED FOR INFORMATIONAL PURPOSES AND MAY NOT ALWAYS BE ACCURATE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUBERPAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless CuberPal and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of the State of California.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the modified Terms.
